Marijuana Packaging in Illinois: How legalization will affect brand owners

Illinois is going to be the first state to use legislation as a means to legalize recreational marijuana. (as opposed to popular vote) Upon Governor JB Pritzker’s signature, marijuana will be legal in Illinois on January 1st, 2020, giving way to a whole new source of taxable income and employment/business opportunities.

Brand owners with traction in the already legal states will be able to increase their production to meet the demand of Illinois consumers. New start-ups and smaller brands will emerge as well.  All of them competing on the shelf for the buyers attention. Just like any other store, packaging design and quality hold a great influence on a consumers decision. But what are the Illinois marijuana packaging regulations at this point? One would assume child resistance and the prohibition of imagery that would entice minors would be a given, but not every state complies the same way.

Illinois has yet to formally announce marijuana packaging regulations. When they do, will there be intermittent changes? If California cannabis law is any indication, there most certainly will be. For now, every state has different requirements, but once regulations hit the federal level, everything will change and start to become more standardized.
